RESOLUTION 2017 - <br />APPROVING A VARIANCE FROM THE SIZE REQUIREMENTS FOR AN <br />ACCESSORY BUILDING LOCATED IN THE SINGLE FAMILY DETACHED <br />RESIDENTIAL (R-3) FOR BRIAN & EUGENIA SJERVEN ON PROPERTY <br />LOCATED AT 14496 GENEVA AVENUE NORTH <br />WHEREAS, Brian & Eugenia Sjerven have requested approval of a variance from the <br />size requirements for an accessory building to allow a total size of 540 square feet where <br />260 square feet is allowed by ordinance for the property legally described as follows: <br />RICE LAKE MEADOWS 4TH ADDITION, LOT 1, BLOCK 2, WASHINGTON <br />COUNTY, MINNESOTA <br />WHEREAS, the Board of Zoning has reviewed said variance at a duly called public <br />hearing on November 9, 2017, and recommends approval with the following findings and <br />conditions: <br />1. The requested variance is permissible by law. <br />2. Because of circumstances unique to the property the applicant is proposing to use <br />the property in a reasonable manner <br />3. The 280 additional square feet on the applicant's current accessory building <br />would not noticeably alter the character of the area. <br />4. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />5. Construction of an accessory building is allowed in the R-3 zoning district. <br />6. The subject property is not within a FEMA designated floodplain. <br />7. The subject property is proposed to be served by municipal sewer and water. <br />8. The applicant must apply and receive a building permit prior to construction of <br />the accessory structure <br />9. The accessory structure shall meet all building code requirements. <br />10. The accessory structure shall resemble, in style, materials, color, roofline, and <br />siding type, the principle building on the lot. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request for Brian & Eugenia Sjerven from the accessory building ordinance to <br />allow a 280 square foot addition on the existing 260 square foot accessory structure for <br />one accessory structure totaling 540 square feet, where 260 square feet is allowed by <br />ordinance. <br />
