RESOLUTION 2017-43 <br />APPROVING AN ORDER REGARDING ACCUMULATION OF RUBBISH, <br />GARBAGE, AND JUNK VEHICLES FOR THE PROPERTY LOCATED AT 13101 <br />HENNA AVE. N. <br />WHEREAS, this Order is made in connection with the property located at 13101 Henna Avenue <br />North in the City of Hugo, County of Washington, State of Minnesota, legally described as: <br />SEE ATTACHED EXHIBIT A <br />(hereinafter the "Property"). The Property is owned by, without limitation, Dennis and Karen <br />Schultz ("Owners"); <br />WHEREAS, the Property contains numerous abandoned, wrecked, unlicensed and other <br />inoperable vehicles, junk and debris; <br />WHEREAS, the City Council held a hearing on September 18, 2017, at which Mr. Schultz <br />attended and spoke to the Council. The Council recommended the property to be brought into <br />compliance by November 15, 2017 and the item to return to the Council for an update on <br />November 20, 2017; <br />WHEREAS, the City Council held a hearing on November 20, 2017, at which the Owners did <br />not attend. The Council recommended approval of the order; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the order to bring the <br />Property into code compliance, subject to the following violations of the Municipal Code <br />Chapter 46, article I., Section 46-2 and 46-3: <br />• Section 46.2 — Public nuisances affecting health, safety, comfort or repose. <br />o (3) The accumulation of garbage and rubbish not in containers, as required by <br />ordinance of the city; <br />o (5) An accumulation of tin cans, bottles, glass, trash or debris of any nature or <br />description; <br />• Section 46.3 — Public nuisances affecting peace and safety. <br />o (1) The piling, storing or keeping of wrecked or junked machines or vehicles and <br />other junk or debris other than by persons involved in commercial business where <br />the city council deems certain accumulations are necessary in the course of <br />transacting business. <br />
