Without limitation, the City is objecting -g -to,.,, the following requirements: <br />1. Requirement that the City'conv,Rr1 the muncip <br />source to a surface water source; <br />2. Residential irrigationwban; <br />3. Reduction in per capita,,,resident ja[water -consum <br />4. Report on coliaborativefforts. <br />system from ground water <br />75 gallons per day; <br />Without limitation, said modifications are arbitrary and capricious, are not supported by <br />.., <br />substantial -evidence and,A4nconsistesrnt with the requirements of Minn. Stat. § 103G et seq <br />and other applicable laws and;rules.ther#and ;additional claims and defenses will be <br />addu(ed at the hearing of thislmatter. Pursba,, t to law, the City of Hugo will not <br />attempt,to comply with the languoge, of the four above -listed amended conditions <br />pending final adjudication\of these 'and,other claims because they do not further <br />groundwater resource, do not further sustainability are wasteful and inconsistent with <br />law. <br />The objection is made,, without limitations, pursuant to the provisions of Minnesota <br />Administrative Rule 6115.0750, Subpart 5B and Minn. Stat. § 103G.311, <br />The City of Hugo demands a contested case hearing pursuant to Minn. Stat. § 103G311, <br />Subd. 5 or other applicable law, including Minn. Stat. § 103G.299. The City requests that <br />any bond be waived and assures payment pursuant to Minn. Stat. § 103G.311, Subd. 7. <br />
