Minutes for the Planning Commission Meeting of Thursday, February 22, 2018 <br />Commissioner Kleissler called the meeting to order at 7:00 p.m. <br />PRESENT: Arcand, Derr, Kleissler, Lessard, Luchsinger, Tjernlund. <br />ABSENT: None. <br />STAFF: Bryan Bear, City Administrator <br />Rachel Juba, Planner <br />Rachel Leitz, Community Development Assistant <br />Approval of Minutes for the Planning Commission Meeting of January 25, 2018 <br />Commissioner Arcand made a motion, seconded by Commissioner Tjernlund, to approve minutes for the <br />meeting of January 25, 2018. <br />All Ayes. Motion carried. <br />Commissioner Lessard Abstained. <br />Review of Conditional Use Permit (CUP) for Lametti & Sons, Inc. <br />Leitz presented on the CUP review for Lametti & Sons, Inc. on property located at 16028 Forest Boulevard. <br />Leitz described that at its January 2, 2007, meeting the City Council approved a CUP for Lametti & Sons, Inc. <br />The CUP allows interior and exterior storage of material and equipment, and processing of cured -in-place pipe <br />that will be completed inside of an existing building. Leitz stated that condition #12 of the permit states that the <br />CUP shall be review every five years from the date of issuance. The last approved review of the permit took <br />place on November 19, 2012. Staff visited the property on January 29, 2018, and is not aware of any violations <br />of the existing conditional use permit. Leitz stated that staff finds Lametti and Sons, Inc. to be in compliance <br />with the CUP and staff recommended approval of the CUP review. <br />Chair Kleissler asked the representative from Lametti & Sons, Inc. if they would like to speak. <br />Mark Jay, project manager at Lametti & Sons, Inc., approached the podium. He stated he was willing to answer <br />any questions the Planning Commission had for the company in regards to the CUP. <br />The Planning Commission had no questions and agreed if the business was in compliance with the CUP, the <br />review should be approved. <br />Commissioner Derr made a motion, Commissioner Arcand seconded, to approve the Conditional Use Permit <br />(CUP) review for Lametti & Sons, Inc. <br />All Ayes. Motion carried. <br />Update on the White Bear Lake/DNR Lawsuit <br />City Administrator, Bryan Bear, provided background on the lawsuit and explained that on January 26, 2018, <br />there was discussion on construction dewatering resulting with an expectation that the prohibition will be <br />removed. Bear felt the order was vague, and the DNR was not providing much direction to the cities. <br />Bear talked about other conditions in the order and the DNR's change to Hugo's appropriations permit and <br />requirement for plans for a partial or total conversion to surface water. Hugo has no viable surface water to <br />support total conversion. A project was presented for a Metropolitan regional project that would cost <br />$630,000,000. The City would have to rely on other entities, and it's difficult to rely on such a plan. The City <br />
