APPROVING A VARIANCE FROM THE PARKING STALL REQUIREMENTS FOR <br />O'REILLY AUTO ENTERPRISES, <br />.a R3'r <br />LOCATED AT 14777 <br />FOREST BOULEVARD NORTH <br />WHEREAS, O'Reilly Auto .Enterprises, LLC, has requested approval of a variance to allow a 26 <br />parking spaces, where 41 parking spaces are required by ordinance for the property legally <br />described as follows: <br />SEE ATTACHED <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing <br />and recommends approval and; <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA., that it should and hereby does approve the request by O'Reilly Auto <br />Enterprises, LLC, for a variance to allow 26 parking spaces, where 41 parking spaces are <br />required by ordinance based on the following findings: <br />1. The proposed variance is permissible by law. <br />2. Parking and loading areas are allowed as an accessory use in the Central Business (C-1) <br />zoning district. A reduced amount of parking for the retail use is a reasonable request. <br />3. The property is with the area guided by the downtown design guidelines. In a typical <br />downtown setting the parking does not meet the strict parking requirements. A typical <br />requirement for retail uses is four parking spaces for each 1,000 square feet of floor area. In <br />that case, for this 6,600 square feet of retail space, 26 spaces would be required. Allowing 26 <br />parking spaces for a retail building of this type is reasonable. <br />4. The variance to allow a reduced number of parking spaces will not noticeably alter the <br />character of the area, <br />5. The applicant has practical difficulties in meeting the ordinance regulations. <br />6. The spirit and intent of the parking regulations in the ordinance is to ensure that adequate <br />parking is in place for the intended use. The proposed parking spaces are adequate for the <br />intended use. The variance on the property will be keeping with the spirit and intent of the <br />ordinance as it develops. <br />7. Parking and loading areas are allowed as an accessory use in the Central Business (C-1) <br />zoning district. <br />8. The property is not located within a FEMA designated floodplain. <br />
