Wetland Replacement <br />The applicant's proposed alternative to develop the site to accommodate the Schwieters expansion plan, <br />will result in 1.58 acres of permanent impact to two (2) type 3 wetlands. This includes impacting all of <br />wetland 2, and a portion of wetland 1. The unimpacted portion of wetland 1, will receive stormwater after <br />pre-treatment. <br />MN Rule 8420.0522 requires that wetland impacts be replaced at a 2.5:1 ratio. The applicant has requested <br />the ratio be reduced by 0.5:1 since replacement for the impacted wetlands will be withdrawn from an <br />approved wetland bank site. The resulting replacement ratio is 2:1. <br />The applicant is proposing to purchase 3.16 acres of type 3 upland and wetland credit from wetland bank <br />1522. BWSR siting requirements for wetland replacement require applicants follow the priority order of <br />using credits within in the same minor watershed, the same major watershed, the same bank service area <br />(BSA), and in another BSA. There are no approved wetland credits within the Hardwood Creek minor <br />watershed, therefore the applicant is proposing to use credits from wetland bank 1522 which is the same <br />major watershed (Mississippi River -Twin Cities). The application includes a purchase agreement for 3.16 <br />acres of wetland credits from wetland bank 1522. <br />Based on the information provided in the Joint Wetland Permit Application prepared by Pinnacle <br />Engineering and dated February 6, 2018, the application for sequencing and wetland replacement is <br />approved with the following conditions: <br />1.) No wetland impacts will occur until the applicant has provided confirmation from BWSR that 3.16 <br />acres of wetland credit has been withdrawn from wetland bank account 1522 to replace the 1.58 acres of <br />proposed wetland impact. <br />2.) No additional impacts will occur to wetlands (temporary or permanent) within the project area beyond <br />the proposed 1.58 acres. <br />3.) Stormwater discharging to wetland 1, will be pre-treated prior to discharge according to stormwater site <br />plans and guidance provided under MN Rule 8420.0112 subp. N. <br />4.) The applicant will provide protections for the remaining portion of wetland 1 and wetland 3 during <br />construction activities. <br />For Replacement Plans using credits from the State Wetland Bank: <br />Bank Account # <br />Bank Service Area <br />County <br />Credits Approved for Withdrawal <br />1522 <br />7 <br />Washington <br />(sq. ft. or nearest .01 acre) <br />3.16 acres <br />Replacement Plan Approval Conditions. In addition to any conditions specified by the LGU, the approval <br />of a Wetland Replacement Plan is conditional upon the following: <br />❑ Financial Assurance: For project -specific replacement that is not in -advance, a financial assurance <br />specified by the LGU must be submitted to the LGU in accordance with MN Rule 8420.0522, Subp. 9 <br />(List amount and type in LGU Findings). <br />❑ Deed Recording: For project -specific replacement, evidence must be provided to the LGU that the <br />BWSR "Declaration of Restrictions and Covenants" and "Consent to Replacement Wetland" forms have <br />been filed with the county recorder's office in which the replacement wetland is located. <br />® Credit Withdrawal: For replacement consisting of wetland bank credits, confirmation that BWSR has <br />withdrawn the credits from the state wetland bank as specified in the approved replacement plan. <br />Wetlands may not be impacted until all applicable conditions have been met! <br />LGU Authorized Signature: <br />BWSR Forms 11-25-09 Page 3 of 4 <br />
