Atkinson acknowledges that he read and understands the foregoing Mining Permit <br />("Atkinson Pit") ("Mining Permit"). Dean Atkinson states that he is executing the Consent included <br />in the Mining Permit as a necessity for him to continue his business. By executing the Consent <br />included in the Permit, Dean Atkinson is not waiving his legal right to bring legal action to <br />challenge the validity of Ordinance No. 95-301 (An Ordinance clarifying the City Ordinances <br />regarding the Operation of Rock Crushers within the Agricultural District of the City) as the <br />Ordinance limits crushing and processing of recycled asphalt and concrete on the subject property, <br />or to challenge the permit, or any past permits. <br />Dean A.
