Impacts are to two (2) separate basins on the <br />property and will impact Wetland No. 2 in its entirety, and a portion of Wetland No. 1. The remaining <br />wetland on the property is not proposed to be impacted. <br />Schwieters is proposing to replace the 1.58 acres of impact to Wetland No. 1 and Wetland No. 2 through <br />the purchase of 3.16 acres of wetland credit from an existing approved wetland bank in the same major <br />watershed, which follows BWSR's replacement siting priority requirements. <br />The applicant had previously submitted a joint application requesting approval for sequencing and <br />wetland impact replacement. This application was approved by Hugo City Council on April 2, 2018, and <br />the subsequent notice of decision was issued on April 3, 2018 which required the use of wetland bank <br />credits from bank #1522. <br />After the Notice of Decision was issued, Schwieters worked with a different consultant to finalize the <br />wetland credit purchase in late May 2018. Unfortunately, there was miscommunication between the <br />consultant who initially prepared the replacement plan application and the consultant who worked to <br />finalize the wetland credit purchase. The second consultant completed the wetland credit transaction <br />using credits from bank #1444, which conflicts with the replacement plan, notice of decision, and BWSR <br />siting requirements. <br />To comply with BWSR siting requirements, Schwieters has submitted a new replacement plan using bank <br />credits from bank #1618, which does meet siting criteria and allows Schwieters to impact wetlands on <br />site. <br />Based on my review of the application and supporting documentation, the requirements under the MN <br />Wetland Conservation Act have been met. The replacement plan application dated July 13, 2018 is <br />attached to this memo. <br />I recommend conditional approval of the Schwieters Joint Application for wetland replacement using bank <br />credits from bank #1618. Conditional approval is recommended since the notice of application was <br />issued today and requires a 15-business day comment period.
