7/31/18 <br />INTERGOVERNMENTAL AGREEMENT BETWEEN THE <br />RICE CREEK WATERSHED DISTRICT AND <br />CITY OF HUGO <br />THIS AGREEMENT is made and entered into by and between the Rice Creek Watershed District <br />("District") and the City of Hugo ("City") (each a "party") each acting by and through its duly <br />authorized officer or representative. <br />THE ABOVE -NAMED PARTIES hereby agree as follows: <br />I. GENERAL SCOPE OF AGREEMENT <br />1.01 The District and City agree to work together to complete the Board of Water and Soil <br />Resources (BSWR) Clean Water Fund (CWF) Project and Practices` Competitive Grant Application <br />(grant application) for the County Road 8 (Frenchman Road) stormwater reuse project. <br />II. SPECIFIC SCOPE OF SERVICES <br />2.01 The District and City agree that it is mutually beneficial to jointly undertake the County <br />Road 8 Stormwater Reuse project to improve surface water quality and reduce the stress on <br />local aquifers due to increased water demands. <br />2.02 District Responsibilities. The District agrees to reimburse;the City for up to 50% (not to <br />exceed $4,300 of the costs associated with the completion `of a CWF Competitive Grant <br />application, on submittal of the completed grant application to the BWSR by August 31, 2018 <br />and within 30 days of receipt of invoices and supporting documentation of eligible costs <br />incurred. <br />2.03 City Responsibilities. The City agrees to complete the BSWR CWF grant application for <br />the County Road 8 Stormwater Reuse project and work with RCWD to submit this grant <br />application to BWSR before the August 31, 2018 deadline. <br />III. COMPENSATION; METHOD OF PAYMENT <br />3.01 On submittal of the completed grant application to BWSR by August 31, 2018 and within <br />30 days of receipt of invoices and supporting documentation of eligible costs incurred, the <br />District will reimburse the City for the District's share of costs incurred relating to the grant <br />application. <br />IV.
