Page 2 <br />individual that would like to use property for a retail body shop, therefore a CUP is required for <br />an expansion of a non -conforming use. <br />In order to change the use from a wholesale business to retail the applicant has applied for a <br />conditional use permit (CUP) to expand the legal non -conforming use. The CUP can only be <br />approved with findings that the expansion will reduce the impacts of the legal non -conforming <br />use on the surrounding properties in terms of activity, noise, traffic, light, appearance, outside <br />storage of vehicles, equipment, or materials, or other issues pertinent to the property and use <br />involved. <br />The applicant has stated that the whole sale auto body business has approximately 75-100 <br />vehicles entering the property throughout the week and approximately 6-10 auto part deliveries <br />per day. The proposed retail auto body business would have 6-10 vehicles entering the property <br />per week and 1-2 auto part deliveries per day. <br />Throughout the week the existing wholesale auto body business uses all of the available parking <br />in the lot and the entire space in the south fenced parking area for preparation for vehicle <br />transports. The applicant has stated that the proposed retail auto body business would only use <br />the parking as shown on the proposed site plan, which is far less that was is currently being used <br />for vehicle parking and storage. Stored vehicles would be inside the building or in designated <br />parking spaces within the fenced area on the south side of the building. Large transport trucks <br />with damaged vehicles will not be allowed to access the property. Other materials related to the <br />business will not be allowed to be stored outdoors. <br />The proposed use would provide a reduction in activity, traffic, and outdoor storage of vehicles; <br />thus, reducing the impact of the use on the surrounding properties. <br />3. LEVEL OF CITY DISCRETION IN DECISION -MAKING: <br />The City's discretion in approving or denying a conditional use permit amendment is limited to <br />whether or not the change meets the standards outlined in the Comprehensive Land Use <br />Regulations. If it meets these standards, the City must approve the conditional use permit. <br />4. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The properties to the north, south, and west, are zoned Central Business (C-1) and are occupied <br />by a gas station, bank, and auto parts store. The property to the east is zoned Central Residential <br />(CR-3) and is occupied by the Historic Legion Post Villa Apartments. The property itself and the <br />surrounding properties are guided Mixed -Use in the 2030 Land Use Plan. <br />0 <br />
