RESOLUTION 2018 - 39 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR SHLAYBA, INC. <br />FOR "THE PRESERVE ON SUNSET LAKE" ON PROPERTY LOCATED SOUTH OF <br />125TH STREET NORTH, EAST OF ILLIES AVENUE NORTH AND NORTH OF 120TH <br />STREET <br />WHEREAS, Shlayba, Inc. has requested approval of a Final Plat to allow construction of <br />13 single family lots and 3 outlots on the 139.7 -acre property legally described as <br />follows: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a <br />duly called public hearing and recommended approval of the preliminary plat and PUD; <br />and <br />WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on <br />November 5, 2018. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by <br />Shlayba, Inc. for a Final Plat, subject to the following conditions: <br />A final plat is approved to allow the creation of 13 single family home lots and 3 <br />outlots, in accordance with the application and plans received by the City on <br />September 5, 2018, September 6, 2018, October 8, 2018, October 12, 2018, and <br />October 18, 2018, except as amended by this resolution. <br />2. The development shall substantially comply with all plans and conditions of the PUD <br />and preliminary plat approval granted by the City on November 5, 2018. <br />3. Development standards shall be as approved PUD general plan approvals dated <br />November 5, 2018. <br />4. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions: <br />a. The developer must comply with all conditions outlined in the City Engineer's <br />memo dated October 18, 2018. <br />b. The developer must obtain all necessary stormwater management permits from <br />the City. <br />c. The developer shall obtain all necessary local, state, and federal permits. <br />d. The applicant shall provide copies of the final Homeowners Association <br />documents/covenants and architectural design guidelines for City review and <br />approval. A copy of the documents shall be filed for recording with the final plat. <br />e. The developer shall enter into a development agreement, shall agree to complete <br />all improvements, and pay all fees as required by the agreement. <br />f. The developer shall deed Outlot B to the City and the remainder as a cash -in -lieu <br />fee of $28,704. <br />
