RESOLUTION 2018 - 38 <br />APPROVING PRELIMINARY PLAT FOR SHLAYBA, INC. <br />FOR "THE PRESERVE ON SUNSET LAKE" ON PROPERTY LOCATED SOUTH OF 125TH <br />STREET NORTH, EAST OF ILLIES AVENUE NORTH AND NORTH OF 120TH STREET <br />WHEREAS, Shlayba, Inc. has requested approval of a preliminary plat to allow construction of <br />13 single family lots and 3 outlots on the 139.7 -acre property legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve the request by Shlayba, Inc. for a <br />preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of 13 single family home lots and 3 <br />outlots, in accordance with the application and plans received by the City on September <br />5, 2018, September 6, 2018, October 8, 2018, October 12, 2018, and October 18, 2018, <br />except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of a rezoning to PUD for the 139.7 - <br />acre site. <br />3. The developer must comply with Resolution 2018-37, for the PUD. <br />4. Park Dedication shall as required by the PUD approval in Resolution 2018-37. <br />5. The preliminary plat plans dated October 12, 2018, shall be revised to include the <br />following revisions, to be reviewed and approved by staff: <br />a. The approved wetlands shall be shown on the plan sheet and the drainage and <br />utility easements shall be modified to comply with the Notice of Decision dated <br />October 16, 2018. <br />6. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions. <br />a. The developer must comply with all conditions outlined in the City Engineer's memo <br />dated October 18, 2018. <br />b. The developer must obtain all necessary stormwater management permits from the <br />City. <br />c. The developer shall obtain all necessary local, state, and federal permits. <br />d. The updated Homeowners Association (HOA) documents for review and approval by <br />staff. <br />e. Architectural design guidelines shall be reviewed and approved by staff. <br />f. A development agreement shall be executed and all fees shall be paid. <br />
