RESOLUTION 2018 - 36 <br />APPROVING FINDING OF FACT FOR REZOING FOR SHLAYBA, INC. <br />FOR "THE PRESERVE ON SUNSET LAKE" ON PROPERTY LOCATED SOUTH OF 125TH <br />STREET NORTH, EAST OF ILLIES AVENUE NORTH AND NORTH OF 120TH STREET <br />WHEREAS, Shlayba, Inc. has requested approval of a rezoning to PUD to allow construction of <br />13 single family lots and 3 outlots on the 139.7 -acre property legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing <br />and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does support the request for the reclassification <br />of the zoning to PUD for the property, based on the following findings: <br />The proposed PUD is appropriately located and will maintain the current development <br />pattern in the area. <br />2. The requested PUD flexibility will improve site design by allowing preservation of <br />wetlands, open space and natural features while maintaining the City density standards. <br />3. The PUD allows for a more creative and efficient approach to land use within the city, <br />while at the same time protecting 'and promoting the health, safety, comfort, aesthetics, <br />economic viability, and general welfare of the city primarily through preservation of open <br />space and nature features. <br />4. The development will preserve and enhance natural features and open spaces. <br />5. The development will provide efficient public streets and utilities. <br />6.
