Exemption 8420.0420 Subp. 6(A) <br />Solar panels will be installed within the delineated boundary of wetlands 1 and 2 on a rack <br />system that utilizes driven posts to support the panel. The applicant is requesting an exemption <br />for the installation of the panel posts based on MN Rule 8420.0420 Subp. 6(A). The applicant <br />has demonstrated that the project has avoided and minimized wetland impacts to the greatest <br />extent possible and that less than'/2 acre of wetlands will be impacted. <br />No -loss 8420.0415 Subp.(A) and MN Rule 8420.0415 Subp. H <br />Fence posts will be installed within the delineated boundaries of wetlands 1 and 2. The <br />applicant is requesting a no -loss under the criteria of MN Rule 8420.0415 Subp.(A) as is <br />supported by MN Rule 8420.0111 Subps. 26 and 32. The applicant is also requesting a no -loss <br />under MN Rule 8420.0415 Subp. H for temporary impacts associated with ground disturbing <br />activities from heavy equipment. This project, as proposed, will satisfy the requirements for <br />no -loss under the MN Rule 8420 sections and subparts referenced above. <br />The application for sequencing, no -loss, exemption, and replacement for permanent wetland <br />impacts is approved with the following conditions to protect the high quality vegetative <br />community, reduce permanent impacts to on -site wetlands, and reduce the loss in the quantity, <br />quality, and biological diversity of on -site wetlands. <br />Conditions: <br />1.) The layout area (shown in the site plan provided with the application and dated 10-10-18) <br />and delineated wetland boundaries will be clearly marked and communicated to contractors to <br />avoid heavy equipment operation in any wetland areas outside of the proposed array. <br />2.) Grading will be minimized to only areas needed to install footings or posts in high quality <br />wetland; no mass grading. <br />3.) Ground disturbing activities only to be completed during dormant period (October -March) <br />and when frost is present at a depth sufficient to minimize soil compaction. Frozen ground <br />conditions may be enhanced or created by clearing snow from the construction corridors by <br />plowing. If frost is not present at a depth that will prevent compaction, the contractor will take <br />precautions that may include the use of mats and/or tracked equipment. <br />4.) As described in the applicant's permit request, disturbed areas will be restored using a <br />native seed mix. The seed mix shall be a custom mix that is limited to and includes high <br />quality native species that are currently found on site. <br />5.) Panels will be installed no higher than the maximum height as allowed by Hugo City <br />ordinance, but the distance between the ground elevation and the panel should be maximized to <br />reduce shading of ground vegetation. <br />6.) The LGU will be allowed access to the site to inspect the facility and complete vegetation <br />monitoring surveys to assess changes in the vegetative community as needed during the 25-year <br />lifespan of the project. <br />7.)
