from and against all claims, damages and other liabilities arising out of the approval or <br /> construction of the Improvements to which the application relates. <br /> SECTION 9 <br /> MAINTENANCE OBLIGATIONS <br /> 9.1 Master Association Obligations._ The Master Association is obligated to, or may <br /> as indicated, provide the following maintenance: <br /> 9.1.1 Maintain, repair and replace the Master Common Elements and all <br /> Improvements thereon, including but not limited to any "greens" and parks, berms, <br /> landscaping, irrigation systems and controls, ponds, private streets, alleys, lighting <br /> fixtures, fencing, trails, retaining walls and related Improvements; <br /> 9.1.2 Maintain, repair and replace the common entrance signs and related <br /> monuments identifying the Master Association and/or the Neighborhoods, whether <br /> located on the Master Common Elements, Neighborhood Property, a Unit or other <br /> property; and <br /> 9.1.3 Maintain, repair and replace the community irrigation system and all <br /> related "greens," berms, landscaping, components, controls, ponds, and related <br /> improvements located on the Master Common Elements, Neighborhood Property and/or <br /> outlots dedicated to the City for drainage or other similar purposes for the benefit of the <br /> Property, to the extent not maintained by the City, except those portions thereof that are <br /> located on and serve only a specific Unit. <br /> The Master Association may undertake such other maintenance, repair and replacement <br /> obligations with respect to the Property as are approved by sixty-seven percent (67%) vote of the <br /> entire Master Board. <br /> 9.2 Neighborhood Association and Owner Obligations. The obligations of the <br /> Owners and the Neighborhood Associations, as applicable, are as follows: <br /> 9.2.1 Neighborhood Associations shall maintain, repair or replace their <br /> respective Neighborhood Property as required by their Neighborhood Governing <br /> Documents, except to the extent maintained by the Master Association. <br /> 9.2.2 Except for Unit maintenance performed by the Master Association or <br /> Neighborhood Association, Owners shall maintain, repair and replace their Units in good, <br /> clean and sanitary condition, and in accordance with the Master Governing Documents <br /> and the Neighborhood Governing Documents for the Neighborhood in which the Unit is <br /> located. Each Owner shall also maintain, repair and replace all portions of the <br /> community irrigation system that are located on and serve only such Owner's Unit. <br /> 9.2.3 Neighborhood Associations and Owners shall maintain (including <br /> mowing), repair and replace trees, grass and landscaping located in the public right-of- <br /> way boulevards adjacent to their Neighborhood Property or Units, except to the extent <br /> maintained by the City or the Master Association. <br /> 27 <br /> 219o398.v1 <br />
