assessment is levied against fewer than all of the Units, then the Master Association shall assess <br /> and allocate against those Units which were not assessed by the governmental authority a share <br /> of the assessment, and reimburse the owners of the Units against which the assessment was <br /> levied, such that all Units are paying substantially an equal share of the assessment. <br /> 16.2 Severability. If any term, covenant, or provision of this instrument or any exhibit <br /> attached hereto is held to be invalid or unenforceable for any reason whatsoever, such <br /> determination shall not be deemed to alter, affect or impair in any manner whatsoever any other <br /> portion of this instrument or exhibits. <br /> 16.3 Construction. The Master Governing Document shall be construed in accordance <br /> with the laws of the state of Minnesota. Where applicable, the masculine gender of any word <br /> shall mean the feminine or neutral gender, or vice versa, and the singular of any word used <br /> herein shall mean the plural, or vice versa. References to MCIOA, or any section thereof, shall <br /> be deemed to include any statutes amending or replacing MCIOA, and the comparable sections <br /> thereof. <br /> 16.4 Notices. Unless specifically provided otherwise in the Master Governing <br /> Documents or MCIOA, all notices required to be given by or to the Master Association, the <br /> Master Association officers, a Member, a Unit Owner or Occupant, or Parcel Owner, shall be (i) <br /> in writing and shall be effective upon hand delivery, or mailing if properly addressed with <br /> postage prepaid and deposited in the United States mail, or (ii) by authenticated electronic <br /> communication and shall be effective when sent, as and if authorized by the Master Bylaws and <br /> Minnesota Statutes Chapter 317A, except as expressly provided otherwise in the Master <br /> Governing Documents. <br /> 16.5 Conflicts Among Documents. In the event of any conflict among the provisions <br /> of MCIOA, this Master Declaration, or the Master Bylaws approved by the Master Association, <br /> MCIOA shall control unless it permits the documents to control. As among this Master <br /> Declaration, and the Master Bylaws, this Master Declaration shall control. The Master <br /> Governing Documents shall control as against any Neighborhood Governing Documents or <br /> Neighborhood Rules. <br /> 16.6 Duration of Covenants.
