8.2.2.4 The Master Board may relinquish and delegate to a Neighborhood <br /> Association part or all of the Design Review Committee's authority to review and <br /> approve or disapprove architectural change applications with respect to the <br /> Neighborhood Property; provided, however, that the Design Review Committee <br /> shall retain the ultimate authority to approve or disapprove such applications. A <br /> delegation of part or all of the Design Review Committee's authority under this <br /> Section 8 shall be in a written document signed on behalf of the Master <br /> Association, the Design Review Committee and the Neighborhood Association to <br /> which the authority is delegated. The Neighborhood Association and any <br /> architectural review committee appointed by it shall follow and be bound by the <br /> same approval procedures and standards as the Design Review Committee. <br /> 8.2.2.5 Until expiration of the Master Developer's authority under this <br /> Section 8, the Design Review Committee shall notify the Master Developer in <br /> writing within three (3) business days following any action (e.g., approval, partial <br /> approval, or disapproval) it takes under this Section 8 and prior to notifying the <br /> applicant of its decision. A copy of the application and any additional <br /> information the Master Developer may require shall accompany the notice. The <br /> Master Developer shall have ten (10) business days after receipt of such notice to <br /> veto any such action, in its sole discretion, by written notice to the Design Review <br /> Committee. <br /> 8.3 Design Guidelines. The Master Developer may prepare the initial Design <br /> Guidelines, which may contain general provisions applicable to all of the Property as well as <br /> specific provisions that vary among uses or locations within the community. The Design <br /> Guidelines are intended to provide guidance to Owners, Builders and contractors regarding <br /> matters of particular concern to the Design Reviewer. <br /> 8.3.1 The Master Developer shall have sole and complete authority to amend <br /> the Design Guidelines for so long as it has review authority under this Section. The <br /> Master Developer's right to amend the Design Guidelines shall continue even if it <br /> delegates reviewing authority to the Design Review Committee, unless the Master <br /> Developer also delegates the power to amend to the Design Review Committee. Upon <br /> termination or delegation of the Master Developer's right to amend the Design <br /> Guidelines, the Master Board may amend the Design Guidelines with the Master Board's <br /> consent. <br /> 8.3.2 Amendments to the Design Guidelines shall apply prospectively only. <br /> They shall not require modifications to or removal of any Improvements previously <br /> approved once the approved construction or modification has begun. However, any <br /> unapproved new work on such Improvements must comply with the Design Guidelines as <br /> amended. There shall be no limitation on the scope of amendments to Design Guidelines, <br /> and such amendments may eliminate requirements previously imposed or otherwise make <br /> the Design Guidelines more or less restrictive. <br /> 8.3.3 The Design Reviewer shall make the Design Guidelines available to <br /> Owners and Builders upon request. <br /> 23 <br /> 219o398.v1 <br />
