Above ground swimming pools of this size that are not surrounded by a <br />fence must have a removable ladder that is removed at all times when the <br />swimming pool is not in use. <br />3. IMPLICATIONS FOR THE CITY <br />Staff has discussed how the swimming pool ordinance will effect residents that already have <br />established swimming pools. From conversations with our Building Official, all permitted <br />swimming pools would have had to meet the requirements of the building code, at that time. <br />The swimming pool ordinance will be in effect for all swimming pools constructed or installed <br />subsequently to the adoption of this ordinance. <br />4. CONCLUSION/RECOMMENDATION: <br />The ORC agreed that the swimming pool ordinance is necessary to have the City's requirements in <br />one location for clarification and ease of resident use. <br />The ORC discussed prior requirements, specifically related to setbacks, and believed that in -ground <br />pools did not create the same visual impact that an accessory structure does, therefore, was <br />comfortable with reducing the rear yard setback requirements. The ORC believed large and small <br />above -ground pools did create the same visual impact of accessory structures, therefore, did not <br />change the rear yard setback requirements. The ORC made special provisions for all noise making <br />mechanical equipment to help further reduce the impact of swimming pools to adjacent property <br />owners. <br />Staff recommends that the Planning Commission open the public hearing and receive comments <br />from the public.
