Notes to Table: <br />1. Building setbacks on side yards fronting public streets shall be the same as the specified front yard setback. <br />2. Church steeples and nonresidential farm buildings are excluded from height limitations. <br />3. No more than 25% of a lot or parcel in the shoreland district may be covered by an impervious surface. <br />(3) Permitted uses within the shoreland district shall be the same as those of the <br />underlying zoning district. <br />(4) Permitted accessory uses in the shoreland district shall be the same as those of <br />the underlying zoning district, and also include: <br />a. One deck or dock not meeting the normal setback requirements from the <br />waterbody as defined in this section, given that the deck meets the <br />following conditions: <br />1. The dock may not occupy an area exceeding 450 square feet in the <br />case of a private dock, nor 600 square feet in the case of a commercial <br />or public dock. <br />2. The dock may not be over six feet wide in relation to the shoreline. <br />3. No dock, platform, deck, or similar structure shall be located within or <br />over the banks of a creek or stream. <br />4. The dock may not block a navigable channel. <br />5. The dock may not extend more than 75 feet past the ordinary high- <br />water level into a lake in the case of a private dock, nor more than 100 <br />feet past the ordinary high-water level in the case of a commercial or <br />public dock. A variance may be granted in accordance with section 90- <br />38 to allow access to navigable waters. <br />6. The treadway of the dock may not be more than two feet above the <br />ordinary high-water level of the waterbody over which it is constructed. <br />7. No walls, roof, or enclosed structure may be constructed on any dock. <br />
