Effective April 28, 2015 Chapter Four Subsurface Sewage Treatment System Regulations <br />SECTION 3 ADMINISTRATION <br />3.1 Administrative scope. <br />This chapter shall apply and be in effect in all areas in Washington County other than cities and towns that have <br />adopted ordinances that comply with Minnesota Statute Section 115.55, Minnesota Rules, Chapter 7082, and are as <br />strict as this Chapter. Pursuant to Chapter One of the Washington County Development Code, the Washington <br />County Department of Public Health and Environment shall be the Administrator of these regulations. SSTS must <br />be designed, constructed and operated according to this Chapter. <br />3.2 Qualifications. <br />SSTS, including both ISTS and MSTS, must be designed, installed, inspected, maintained, repaired, and operated <br />by licensed businesses and certified individuals meeting the qualifications in Minnesota Rules 7083.0700 to <br />7083.2040. SSTS must conform to all applicable state laws and rules and local requirements. <br />3.3 Federal regulations. <br />SSTS that are designed to receive sewage or nonsewage from a two family dwelling or greater or receive sewage or <br />nonsewage from another establishment that serves more than 20 persons per day, are regulated by the United States <br />Environmental Protection Agency as Class V injection wells under Code of Federal Regulations, title 40, parts 144 <br />and 146. Code of Federal Regulations, title 40, parts 144 and 146, prescribe additional design regulations <br />applicable to certain systems designed under this Chapter. In addition, single family dwellings that receive <br />nonsewage wastewater are regulated by these federal regulations. All systems that receive hazardous wastes are <br />regulated by the Unites States Environmental Protection Agency as Class IV injection wells. Disposal of hazardous <br />waste must be according to state and federal regulations. The owner or owner's agent of a new or replacement <br />system classified as a Class V injection wells shall submit to the commissioner of the MPCA and the United States <br />Environmental Protection Agency the inventory information specified in Code of Federal Regulations, title 40, <br />section 144.26. All Class V injection wells must be identified as such in property transfer disclosures. <br />3.3 Variance procedures. <br />If the Department finds that by reason of exceptional circumstances, the strict enforcement of any provisions of this <br />Chapter would cause undue hardship or that strict conformity with the standards would be unreasonable, <br />impractical, or not feasible under the circumstances, the Department may permit modifications in individual cases <br />based on conditions it may prescribe for prevention, control or abatement of pollution, with the exception of <br />sections related to setbacks or zoning. Modifications related to setbacks or zoning shall be heard by the Washington <br />County Board of Adjustment and Appeals. The Department cannot issue variances for Sections 4.1, 4.7, 4.8, 4.9, <br />and Sections 16.2 (1) through Section 16.2 (4). The Department can grant a variance for Section 4.8 (4) (A) for <br />replacement MSTS serving existing dwellings or other establishments.. <br />3.4 Board of adjustment and appeals. <br />Consistent with the procedures in Chapter One of the Washington County Development Code, Section 6.1 (1), the <br />Washington County Board of Adjustment and Appeals shall hear and decide appeals of any order, decision or <br />determination made by the Department regarding the enforcement of this Chapter. Appeals of any administrative <br />decision or determination may be filed by any person, county department, or township. All requests for a variance <br />to requirements of this Chapter shall follow the procedure in Chapter One of the Washington County Development <br />Code. <br />3.5 Adherence to these standards <br />All subsurface sewage treatment systems installed subsequent to the adoption of this Chapter and all alterations, <br />extensions, modifications or repairs to existing systems irrespective of the date of original installation shall be <br />regulated in accordance with all requirements of this Chapter. <br />20 Washington County Development Code <br />
