CITY OF <br />EST. 1906 <br />To: Hugo City Council <br />From: City Clerk Michele Lindau <br />Date: March 19, 2019 for Council Meeting on April 1, 2019 <br />Memorandum <br />Re: Drug and Alcohol Testing for Commercial Drivers Policy, Elimination of the <br />Motor Vehicle Safety Policy, and Revisions to the Personnel Policy <br />In response to regulations issued by the United States Department of Transportation <br />(DOT), staff is requesting Council approve the adoption of the attached policy on drug <br />and alcohol testing for commercial drivers. This policy would apply to employees who <br />hold CDLs (Commercial Drivers Licenses) for the purpose of carrying out "safety - <br />sensitive duties" using City vehicles. These would include Public Works employees who <br />drive vehicles with a gross combination weight rating or gross combination weight of <br />26,001 pounds or more. This policy does not pertain to firefighters. The Federal <br />Highway Administration has granted states the option of waiving CDL requirements for <br />firefighters, and the state of Minnesota has opted to not require it. <br />Hugo's Personnel Policy requires each employee, as a condition of employment, to <br />participate in a pre -employment drug test and be subject to post -accident, return -to -duty, <br />reasonable suspicion, random and follow-up testing upon selection or request of <br />management. Adoption of the Drug and Alcohol Testing for Commercial Drivers Policy <br />would further required CDL holders to be part of a pool of drivers that will be subject to <br />unannounced alcohol and controlled substance testing on a random selection basis. <br />Public Works employees will be registered in a pool with approximately 250 other <br />members. This pool is managed by Cornerstone Occupational Health Specialists in Hugo <br />located on Mercantile Drive. Cornerstone uses a computerized program as a scientifically <br />valid method to draw names for random testing. Federal law requires a test rate of at <br />least 25% of the average number of drivers and 10% for alcohol each year, and these rates <br />are subject to change by the DOT. Cornerstone will send notice of the selected <br />employees to the designated City representative, the City Clerk, who will notify the <br />Public Works Director and schedule the test. The Drug and Alcohol Testing Policy <br />covers collection and testing procedures, review and notification of test results, and <br />consequences for drivers engaged in prohibited conduct. <br />In addition to approval of the Drug and Alcohol Testing Policy, staff is requesting <br />Council approve elimination of the Motor Vehicle Policy and move certain items from <br />the Motor Vehicle Policy to the general Personnel Policy. <br />
