Agenda Number D.2 <br />CITY OF HUGO COMMUNITY <br />DEVELOPMENT DEPARTMENT <br />PLANNING AND ZONING <br />APPLICATION STAFF REPORT <br />TO: Hugo Planning Commission <br />FROM: Rachel Juba, Community Development Director <br />SUBJECT: Kieger Enterprises. Conditional use permit review for property <br />located at 5885 -165th Street North <br />DATE: January 18, 2019, for the Planning Commission Meeting of January 24, <br />2019. <br />1. OVERVIEW: <br />Kieger Enterprises has a conditional use permit (CUP) to operate an environmental clean- <br />up business, garden center, and landscaping supply business for property located at 5885- <br />165t` Street North. On April 15, 2000, the city council approved the CUP for the <br />environmental clean-up business which includes vehicle repair facilities, cold storage, <br />exterior storage of vehicles and equipment, and company offices. On May 8, 2003, the <br />City Council approved an amendment to the conditional use permit to allow a portion of <br />the property to be used as a garden center and a landscape supply business. The <br />conditional use permit amendment was approved subject to seventeen conditions of <br />approval. One of the conditions of approval is that the CUP shall be reviewed and <br />renewed after an initial two year period, with a four year review and renewal period <br />thereafter. On September 16, 2013, the City Council approved the renewal of the CUP <br />and directed staff to review the CUP again in four years to ensure the applicant continues <br />to meet city ordinances and the conditions of approval. The four year review of the CUP <br />is due for review and renewal. <br />2. ANALYSIS: <br />Upon inspection of the property on October 22, 2018, staff observed that an additional <br />building was constructed on the property without a building permit. Further, condition <br />number 11 in the CUP states that "the number of buildings, amount outdoor storage, and <br />uses identified on the site plan dated February 14, 2000 and the application dated April <br />
