RESOLUTION 2019 - <br />APPROVING THE RENEWAL OF THE CONDITIONAL USE PERMIT FOR <br />KIEGER ENTERPRISES INC LOCATED AT 5885165TH STREET NORTH <br />WHEREAS, Kieger Enterprises has an existing conditional use permit (CUP) for an <br />environmental cleanup business, including vehicle repair facilities, cold storage, exterior <br />storage of vehicles and equipment, and company offices. The conditional use permit also <br />allows for a landscape supply and garden center on the property. The property is legally <br />described as: <br />SEE ATTACHED <br />WHEREAS, Kieger Enterprises shall meet all of the conditions listed in the conditional <br />use permit dated September 5, 2000, <br />WHEREAS, condition number 11 in the CUP states that " the number of buildings, <br />amount outdoor storage, and uses identified on the site plan dated February 14, 2000 and <br />the application dated April 15, 2000, shall not be enlarged or expanded, unless a new <br />conditional use permit is applied for and approved", <br />WHEREAS, upon inspecting the property on October 22, 2018, staff observed that an <br />additional building was constructed on the property without a building permit, <br />WHEREAS, the applicant did not apply for a CUP amendment or receive approval of a <br />building permit for the building, <br />WHEREAS, the applicant shall remove the additional building from the property prior to <br />June 1, 2019, <br />WHEREAS, staff will inspect the property prior to June 1, 2019, to ensure compliance <br />with the CUP, <br />WHEREAS, if the building is not removed the property will be in violation of the CUP, <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />renewal of the conditional use permit for Kieger Enterprises located at 5885 165th Street <br />North. <br />ADOPTED by the City Council this 4th day of February, 2019 <br />Tom Weidt, Mayor <br />ATTEST: <br />
