RESOLUTION 2003 -17 <br />APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR A <br />LANDSCAPE SUPPLY BUSINESS AND GARDEN CENTER ON PROPERTY <br />LOCATED AT 5885-1658 STREET NORTH <br />WHEREAS, Kieger Enterprises, Inc. has an existing conditional use permit for an <br />environmental clean-up business, including vehicle repair facilities, cold storago, exterior <br />storage of vehicles and equipment, and company offices and has made application to <br />allow a landscape supply business and garden center on property legally described as <br />follows: <br />That part of the southeast quarter of the Section 8, Township 31 North, Range 21 <br />West, Washington County, Minnesota <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public <br />meeting and recommends approval of the conditional use permit amendment. <br />NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit for Kiegear Enterprises on property located at 5885-l&6 Stied <br />North subject to the following conditions: <br />1. The use must not have sewage disposal needs which exceed three residential <br />equivalencies as determined by Metropolitan Council Environmental Services <br />standards. <br />2. The property must meet the Dimensional Requirements for Standard <br />Development outlined in Figure 3-2 of the City's Comprehensive Land Use <br />Regulations. <br />3. No land use may produce obnoxious or continuous smoke, as measured at the <br />point of emission, by any means. All emissions shall comply with Minnesota <br />Rules, Chapter 7011. <br />4. All landscaping indicated on the Site Plan da ed February 14, 2000 (revised Jum <br />15, 2000) must be maintained in accordance with the requirements of Section 5.18 <br />of the City's Comprehensive Land Use Regulations. <br />5. Conformance with the Section 6 - Performance Standards, with particular <br />reference to the following. <br />
