Minutes for the Planning Commission Meeting of Thursday, January 10, 2019 <br />Chair Kleissler called the meeting to order at 7:01 p.m. <br />PRESENT: Arcand, Derr, Fry, Kleissler, Lessard, Luchsinger, Mulvihill, Tjemiund. <br />ABSENT: None. <br />STAFF: Rachel Juba, Community Development Director <br />Emily Weber, Community Development Assistant <br />Approval of Minutes for the Planning Commission Meeting of October 25, 2018 <br />Commissioner Arcand made a motion, seconded by Commissioner Tj emlund, to approve minutes for the meeting <br />of October 25, 2018. <br />All Ayes. Motion carried. <br />Ordinance Adopting Rice Creek Watershed District by Reference <br />Juba started by giving background information on the City's Water Resource Management Plan, which guides <br />the City on administration and implementation on all stormwater management practices in the City. The plan was <br />approved by the City Council in 2015 and at that time the City put together goals and policies that were intended <br />to guide the City moving forward. Since then, the Rice Creek Watershed District went through rule changes so <br />the City sent out the new plan in July 2018 to align with those changes. That plan was approved. The new Water <br />Resource Management Plan will be incorporated into the 2040 Comprehensive Plan. The plan states that the City <br />will continue to be the local governing unit (LGU), meaning the City is responsible for reviewing and approving <br />all activities regarding stormwater management, erosion control, floodplain alterations, and wetland alterations. <br />The City has a memorandum of understanding that outlines what rules can be administered on behalf of Rice <br />Creek Watershed District. To retain authority, the City will need to update the memorandum of understanding <br />and adopt the new Rice Creek Watershed District rules by reference. One thing to note is that the City has been <br />following these rules since 2004 when they began exercising its LGU authorities. These rules apply to any activity <br />that happens in the City. Juba went on to explain each rule in detail. Staff recommended approval of the ordinance <br />as written. <br />Staff recommended that the Planning Commission open the public hearing and take all comments. <br />Chair asked if there were any questions. <br />Arcand asked staff to clarify that the City had to apply to the Rice Creek Watershed District to be the LGU and <br />Juba confirmed that yes, the City went through the process to become the LGU. <br />Kleissler opened the public hearing at 7:09 pm. <br />Kleissler closed the public hearing at 7:09 pm. <br />Derr commented that to see the stormwater reuse ponds in use today, not just on plans, is really neat and is a <br />tremendous credit to the City. <br />Arcand made motion to approve that the City adopt the Rice Creek Watershed District Rules C, D, E, and F by <br />reference as a standalone ordinance. Derr seconded. <br />All ayes. Motion carried. <br />
