RESOLUTION 2019 - <br />APPROVING APRELIMINARY PLAT AND PUD AMENDMENT FOR HUGO <br />VENTURES, LLC, FOR WATERS EDGE 6TH ADDITION <br />WHEREAS, Hugo Ventures, LLC, has requested approval of a Preliminary Plat and PUD <br />Amendment for "Waters Edge 6th Addition" on property legally described as follows: <br />See attached <br />WHEREAS, Planning Commission has reviewed the preliminary plat and PUD <br />amendment at a duly called Public Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does the request by <br />Hugo Ventures, LLC, for a Preliminary Plat and PUD Amendment for "Waters Edge 6th <br />Addition"; subject to the following conditions: <br />1. A preliminary plat is approved to allow the construction of 37 single family villa <br />homes (patio homes) and 1 outlot (common space) in accordance with the plans <br />received by the City on March 19, 2019, April 16, 2019, April 22, 2019, April 29, <br />2019, and May 5, 2019, except as amended by this resolution. <br />2. Development standards shall be according to the preliminary approvals granted by <br />the City Council on December 16, 2002 (Resolution 2002-65, 2002-66 and 2002-67) <br />and as amended on December 15, 2003 (Resolution 2003-65), and as amended with <br />this resolution. <br />3. The plans shall be revised to label all private utilities. <br />4. HOA documents or written confirmation that the homes will be covered under the <br />HOA established for the previous phases of this development must be submitted <br />to the City Attorney for review and approval. <br />5. The HOA shall be responsible for the following: <br />a. All landscaping in the development and common areas/outlot. <br />b. All retaining walls <br />c. Private streets and sidewalks <br />d. Private utilities (sanitary sewer, stormsewer, and watermain) <br />6. Cross access and maintenance agreements as well as drainage and utility <br />easements shall be recorded with the final plat for all private drives. <br />7. Park dedication requirements were fulfilled with the first phase of this <br />development when the park land was dedicated to the City. No additional <br />dedication is due with this phase. <br />8. The development shall comply with the following setbacks: <br />Minimum front yard setback from private drive 125 feet <br />
