RESOLUTION 2019-29 <br />APPROVING A CONDITIONAL USE PERMIT TO ALLOW A LAKE ACCESS <br />LOT ON THE PROPERY LOCATED AT 12862 ETHAN AVENUE NORTH <br />WHEREAS, Steve Bona, requested approval of a conditional use permit to allow a lake <br />access lot on the property located at 12862 Ethan Avenue North. <br />WHEREAS, the subject properties are legally described as follows: <br />LOT 5, BLOCK 1, WOODS OF BALD EAGLE LAKE, ACCORDING TO SAID PLAT <br />ON FILE AND OF RECORD IN THE OFFICE OF THE COUNTY RECORDER, <br />WASHINGTON COUNTY, MINNESOTA, AND THAT PART OF GOVERNMENT <br />LOT 1, SECTION 31, TOWNSHIP 31, RANGE 21, WASHINGTON COUNTY, <br />MINNESOTA, <br />WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly <br />called public hearing on May 23, 2019, and recommends approval subject to the <br />conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit for a lake access lot for the property located at 12862 Ethan <br />Avenue North subject to the following conditions; <br />1. Covenants shall be recorded on the property including all of the following <br />conditions. <br />2. The lake access lot shall only be used by the owner (single user). <br />3. The property, dock, boat slips, and parking area shall not be rented or used as a <br />private or commercial marina. <br />4. The dock shall have a maximum of three boat slips. <br />5. No motor vehicle, recreational vehicle, or boat storage is allowed on the property. <br />6. A fire pit and picnic table are allowed. <br />7. There shall be no buildings allowed on the property. <br />8. The parking area shall be paved with asphalt. <br />9. The parking lot layout shall be revised to show only two parking spaces. Staff <br />shall review and approve the parking area layout prior to construction. <br />10. The applicant shall get all required local, State, and Federal permits as required. <br />11. All Shoreland Overlay District requirements under Section 90-137 of Hugo City <br />Code shall be followed. <br />
