MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />JUNE 9, 2016 <br />Chairperson Weidt called the meeting to order at 6:30 p.m. <br />PRESENT: Patzner, Weidt. <br />ABSENT: Boland. <br />ALSO PRESENT: Rachel Juba, Planner <br />Rachel Leitz, Community Development Assistant <br />Approval of Minutes <br />Weidt made a motion, Patzner seconded, to approve the minutes for July 23, 2015, as presented. <br />All Ayes. Motion carried. <br />Barnhart — Variance requests for side yard setback located at 5368 145' Street North <br />Community Development Assistant, Leitz, presented on a variance request to allow a three foot <br />side yard setback, where City ordinance requires a ten foot side yard setback, to expand a finished <br />porch on the applicant's home. Ms. Barnhart also has a garage that doesn't meet current ordinance <br />standards. She has stated that this garage will be removed and construction of a new one will occur <br />to meet ordinance standards, therefore the Board is only considering one variance request. <br />Leitz described the criteria staff uses to evaluate variances, most notably: reasonable use, unique <br />circumstances, character of neighborhood, and spirit and intent. Leitz stated that the unique <br />circumstance for this request was that setbacks for zoning districts are set for required minimum <br />lot widths. The minimum lot width in this zoning district is 80 feet. The property is unique in <br />that it is a narrow lot (50 feet wide) with an existing home that has been constructed three feet <br />from the west side property line. <br />It was in staff's opinion that there are practical difficulties in meeting the requirement for a ten <br />foot side yard setback. Leitz concluded saying that staff recommends approval of the variance <br />request for the side yard setback of three feet in order to construct the proposed porch addition. <br />Chairperson Weidt asked the applicant what year the house built. <br />April Barnhart stated the home was constructed in 1926 and she has lived there since 1998. She <br />said that adding this four season porch will help with renovations to the home as there are <br />difficulties with smaller door frame widths and other elements that make the older home difficult <br />for modern appliances and other features. <br />Patzner asked for clarification that the porch would be constructed so it would be flush with the <br />current home and would not extend further into the side yard setback. <br />Leitz stated that was correct. <br />
