(Above Space Reserved for Recording Information) <br />STORMWATER RE -USE AGREEMENT <br />(Waters Edge 511 Addition, Hugo, Minnesota) <br />THIS STORMWATER RE -USE AGREEMENT (this "Agreement") is entered into as of this <br />day of , 2019, by and between the CITY OF HUGO, a Minnesota <br />municipal Corporation (the "City") and PRAIRIE VILLAGE VILLAS ASSOCIATION, a <br />Minnesota nonprofit corporation serving Prairie Village Villas, a planned community incorporating <br />the real property in Washington County legally described as Waters Edge 50' Addition (the "HOA"). <br />RECITALS <br />A. Stormwater ponds (the "Ponds") are located on property owned by the City and <br />legally described as: <br />Outlot A, Waters Edge South Third Addition, Washington County, Minnesota (the "City <br />Outlots"). <br />B. The City desires to allow stormwater to be pumped out of the Ponds to provide <br />irrigation water to certain common elements within the Waters Edge 5"' Addition (the "Common <br />Elements") which are more particularly described as the greenspace on Oneka Parkway right of way <br />located between Prairie Trail North and the Northern Plat boundary of Waters Edge 5' Addition, and <br />the common space elements within Waters Edge 5' Addition (the "Common Elements"). <br />C. A distribution system has been constructed as part of the Waters Edge Phase I Water <br />Reuse Project and is being expanded to serve more of the Waters Edge development and the Prairie <br />Village development including the Waters Edge 5t" Addition, as part of the Waters Edge Phase II <br />Water Reuse Project. This distribution system will be used, in part, to provide irrigation water to the <br />Common Elements. <br />This Agreement pertains solely to new and existing irrigation infrastructure being installed or already <br />Page 1 <br />
