RESOLUTION 2019 - <br />APPROVING A VARIANCE FROM THE FRONT YARD SETBACK REQUIREMENTS <br />IN THE GENERAL INDUSTRIAL (I-3) ZONING DISTRICT FOR MINNESOTA BUILT <br />HUGO MINNESOTA, LLC, ON THE PROPERTY LOCATED AT 5560 152nd STREET <br />NORTH <br />WHEREAS, Minnesota Built Hugo Minnesota, LLC, has requested approval of a variance to <br />allow a building to be 0 feet from the front property line along Highway 61, where 30 feet is <br />required by ordinance for the property legally described as follows: <br />See Attachment <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing <br />and recommends approval and; <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by Minnesota <br />Built Hugo Minnesota, LLC, for a variance to allow a building to be 0 feet from the front <br />property line along Highway 61, where 30 feet is required by ordinance based on the following <br />findings: <br />1. The proposed variance is permissible by law. <br />2. Placing a building in that location is a reasonable use of the property. <br />3. The property has constraints due to the natural features on the property and the limited <br />buildable area on the site. The right-of-way easement further limits the buildable area if <br />all setback were meet, creating a very small area to build. The right-of-way easement was <br />required to be dedicated with the approval of the previous site plan, creating a new <br />setback requirement for the site. The building is 39 feet from the west front property line. <br />4. The new proposed three story building would be in line with the existing buildings on the <br />property. The variance, if granted, would not alter the character of the surrounding area. <br />5. There are practical difficulties in meeting the ordinance standard. <br />6. The spirit and intent of the ordinance is to have buildings a reasonable distance from the <br />property lines and roads. The new proposed three story building would be in line with the <br />existing buildings on the property. There are homes on the area that are a similar distance <br />from Highway 61 as the proposed building. Allowing a building to be setback to align <br />with the existing buildings would meet the spirit and intent of the ordinance. <br />7. The use is allowed in the zoning district. <br />8. Part of the property is within the floodplain overlay district. The applicant will be <br />
