RESOLUTION NO.2020- <br />A RESOLUTION APPROVING THE RELEASE OF THE DEVELOPMENT AGREEMENT <br />AND RESTRICTIVE COVENANT FOR A PROPERTIES LOCATED GENERALLY SOUTH <br />OF 177TH STREET NORTH AND WEST OF HENNA AVENUE NORTH <br />WHEREAS, on March 7, 1994, the City Council approved a minor subdivision of a twenty acre parcel <br />into two ten acre parcels; <br />WHEREAS, the approval required the combination of the parcels legally described below; <br />See attached <br />WHEREAS, Washington County declined the parcel combination; <br />WHEREAS, on February 21, 1995, the City Council approved and entered into a development <br />agreement and restrictive covenant which states that the properties shall be considered as one lot and <br />cannot be sold separate and the document is recorded in Washington County as document number <br />840822; <br />WHEREAS, the properties have been used and taxed as separate parcels; <br />WHEREAS, the property owner has requested the properties be released from the development <br />agreement and restrictive covenant; <br />WHEREAS, on January 6, 2020, the property owner received approval of a variance and conditional <br />use permit from the City Council; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUGO: <br />1.
