RESOLUTION 2020- <br />APPROVING PUD GENERAL PLAN FOR FENWAY LAND COMPANY FOR <br />"RICE LAKE RESERVE" ON PROPERTY LOCATED EAST OF GOODVIEW <br />AVENUE NORTH AND NORTH OF EGG LAKE ROAD (CSAH 8) <br />WHEREAS, Fenway Land Company, has requested approval of a PUD general plan to <br />allow approximately 93 single family residential lots and 3 outlots on the 51.5 acre <br />property legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Fenway Land Company, subject to the following conditions: <br />1. A PUD general plan is approved to allow the creation of approximately 93 single <br />family residential lots and 3 outlots. The development shall be constructed in <br />accordance with the application and plans received by the City on October 23, 2019, <br />November 15, 2019, and December 4, 2019, except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested rezoning of the <br />51.5 acre property and preliminary plat. <br />3. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />4. The developer shall comply with all conditions in the City Engineer's letter dated <br />December 12, 2019 and all red -lined comments provided to the applicant. <br />5. PUD flexibility is granted to allow: <br />a. Flexibility to allow a minimum lot size of 7,089 square feet, where 10,400 square <br />feet is required. <br />b. Flexibility to allow a minimum lot width of 55 feet, were 80 feet is required by <br />ordinance. <br />c. Flexibility to allow a minimum front setback of 20 feet for corner lots for the side <br />of the home, where 30 feet is required. <br />d. Flexibility to allow a minimum side yard setback of 7.5 feet, where 10 feet is <br />required. <br />e. Flexibility to allow a maximum impervious coverage of a lot to be 55%, where <br />50% is required. <br />6. Flexibility from the shoreland overlay district regulations. <br />
