Conditional <br />use permit request for a shared driveway on properties generally located <br />north of 122" d Street North and west of Keller Avenue North. <br />DATE: December 30, 2019 for the City Council Meeting on January 6, 2020. <br />ZONING: Agricultural (AG) <br />REVIEW DEADLINE: March 4, 2020 <br />1. PLANNING COMMISSION UPDATE: <br />At its December 19, 2019 regularly scheduled meeting, the Hugo Planning Commission <br />considered the conditional use permit application submitted by Jeff Penton and Shirley E. Nelson - <br />Hill Revocable Trust and held a public hearing. No one spoke at the public hearing. Staff provided <br />background and recommended approval of the request. The Planning Commission agreed that the <br />request met the criteria necessary to approve the application and recommended approval of the <br />conditional use permit request to the City Council. <br />2. DESCRIPTION OF REQUEST: <br />The applicant is requesting approval of a conditional use permit (CUP) for a shared driveway <br />between two parcels. The applicant's property is currently landlocked and they are requesting <br />access to Keller Avenue North through a neighboring parcel to the south. Both property owners <br />have signed an easement and maintenance agreement. <br />3. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The properties are zoned Agricultural (AG) and are determined as Agricultural in the 2040 Land <br />Use Plan. Both properties are over 10 acres and are currently vacant. The surrounding properties <br />are also zoned AG and are large lots that are either vacant or occupied by single family homes. <br />
