Variance and Conditional Use Permit (CUP) request for properties located south of 1771h Street and west of Henna Avenue North. Request to terminate the existing development agreement on the properties located at 7355 177th Street North and 17530 Henna Avenue North. DATE: December 31, 2019, 2019 for the City Council Meeting of January 6, 2020 COMPREHENSIVE PLAN: Agricultural (AG) ZONING: Future Urban Service (FUS) REVIEW DEADLINE: 120-days — March 5, 2020 1. PLANNING COMMISSION UPDATE: At its Thursday, December 19, 2019, meeting the Planning Commission considered and held a public hearing on the request. Staff provided background on the request and recommended approval to the Commission. There was no one who spoke during the public hearing except the applicant's representative who thanked the Planning Commission for considering the request. The Planning Commission agreed that the applications met the criteria necessary to approve the variance and CUP requests and recommended approval of the applications to the City Council, subject to the conditions listed the resolutions. The Planning Commission also recommended approval of the release of the covenant against parcel 7355 1771h Street North and 17530 Henna Avenue North, if the variance and CUP are approved with the conditions listed in the resolutions. 2. DESCRIPTION OF REQUEST: The applicant is requesting approval a variance for the property located at 17530 Henna Avenue North for the property to have 0 feet from street frontage, where 300 feet is required by ordinance. The property is an existing land locked parcel with an existing home. The applicant is also requesting approval of a conditional use permit (CUP) for shared driveway that provides access to 3 parcels, parcels A, B, and C (17530 Henna Avenue North, 17590 Henna Avenue North, and 7355 177th Street North,).
