Scanlan Variance and CUP <br />(3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and <br />intent of this chapter and with the policies of the City's Comprehensive Plan. <br />The spirit and intent of the ordinance is to ensure parcels in the FUS zoning have adequate street <br />frontage for access to the parcel. The property does have approval to cross parcel B with a shared <br />driveway to access the parcel. The property has adequate access to a public street and meets the <br />spirit and intent of the ordinance. <br />(4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use <br />prohibited in the district. <br />The use is allowed in the FUS zoning district. <br />(S) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood <br />protection than required by this chapter. The variance shall be determined the minimum <br />necessary, considering the flood hazard, to afford relief, and the variance shall not be issued <br />within any designated regulatory floodway if any increase in flood levels during the base flood <br />discharge would result. <br />The property is not located within a floodplain area. <br />(6) Septic and Well Compliance. The sewage treatment system and water system of the subject <br />property is in compliance with city and state codes. <br />The property is served by well and a septic system. <br />CUP Request <br />The applicant is also requesting approval of a conditional use permit (CUP) for shared driveway <br />that provides access to 3 parcels, parcels A, B, and C (17530 Henna Avenue North, 17590 Henna <br />Avenue North, and 7355 177t' Street North,). Shared driveways require approval of a CUP. The <br />shared driveway is already established and has been used to access the properties for several <br />years. <br />Staff used these standards to review the application and found that the request meets all <br />applicable standards as follows: <br />1. The proposed use is permissible by law. <br />The proposed use is allowed by conditional use permit. <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br />The proposed use is allowed in the FUS zoning district and will keep with the spirit and intent of <br />the ordinance, which is intended to allow a shared driveway by a CUP as long as they comply <br />with the regulations. <br />
