RESOLUTION 2020-9 <br /> APPROVING PRELIMINARY PLAT FOR FENWAY LAND COMPANY FOR <br /> "RICE LAKE RESERVE" ON PROPERTY LOCATED EAST OF GOODVIEW <br /> AVENUE NORTH AND NORTH OF EGG LAKE ROAD (CSAH 8) <br /> WHEREAS, Fenway Land Company, has requested approval of a preliminary plat to <br /> allow construction of approximately 93 single family lots and 3 outlots on the 51.5 acre <br /> property legally described as follows: <br /> (See Attached) <br /> WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly <br /> called Public Hearing and recommends approval, and; <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br /> request by Fenway Land Company, for a preliminary plat, subject to the following <br /> conditions: <br /> 1. A preliminary plat is approved to allow the creation of 93 single family home lots <br /> and 3 outlots, in accordance with the application and plans received by the City on <br /> October 23, 2019, November 15, 2019, and December 4, 2019, except as amended <br /> by this resolution. <br /> 2. Approval is contingent upon City Council approval of a rezoning to PUD for the <br /> 51.1 acre site. <br /> 3. The developer must comply with Resolution 2020-8, for the PUD. <br /> 4. The developer must comply with all conditions outlined in the City Engineer's <br /> memos dated December 12, 2019 and all red-lined comments provided to the <br /> applicant. <br /> 5. Park Dedication is proposed to be satisfied by fee. The park dedication fee shall be <br /> paid for each lot platted at the amount of$2,400.00. <br /> 6. A stormwater re-use system, as shown in the plans, shall be constructed with the <br /> development. The final plans shall be reviewed and approved by staff. The system <br /> will be installed by the applicant, and owned/operated/maintained by the <br /> homeowner's association. A stormwater reuse agreement shall be reviewed an <br /> approved by staff and recoded at Washington County. <br /> 7. The developer has indicated that an HOA will be established for the development to <br /> own/operate/maintain community areas, landscaping, and the water re-use system. <br /> The HOA documents shall be reviewed and approved by staff prior to the recording <br /> of the final plat for the Phase 1. <br />
