Page 7 <br />an access permit from MNDOT and a permit to work within the right of way on Highway 61. <br />The access from Highway 61 for the first phase is proposed to be a full access with turn lanes. <br />There is already a full access designed for the site across from 146th Street that has been <br />permitted by MnDOT. In addition, the applicant is proposing shared parking for the entire PUD. <br />Staff is generally comfortable with shared parking based on the proposed uses. The applicant will <br />be required to record a shared parking and maintenance agreement benefiting of the properties to <br />the north and south. <br />MnDOT provided a comment letter on February 26, 2020. Comments within this review letter <br />will need to be addressed. Most of these comments are routine in nature, however the comments <br />related to traffic safety will require additional study. Since the northern access will require <br />geometric changes to TH 61, it will need to be reviewed through the Level 2 Layout review <br />process. This process will identify if the northerly access can be constructed as proposed and if it <br />can remain as a full access once the southerly entrance is constructed. Alternatively, if this access <br />is not approved by MnDOT, the applicant can access the restaurant site via a driveway <br />connection from the existing full access across from 146th Street. Staff will continue to work with <br />the applicant an the access points. <br />The property owner to the north along Highway 61 has their driveway on the City owned <br />property. The applicant is working with the property owner on access to their property. This is <br />required as a condition of approval. <br />B. Preliminary Plat <br />The preliminary plat includes one lot and one outlot. The lot is for the restaurant site plan. The <br />applicant will be required to apply for a final plat to create the lot for the restaurant. Park <br />dedication is not required for commercial developments. <br />Lot Sizes <br />The applicant is proposing to subdivide the existing 4.2 acre property to create commercial lots. <br />The restaurant will be 2 acres and will be Phase 1. Phase 2 includes three retail buildings on the <br />remaining 2.2 acres. At the time of approval for Phase 2, the lots could be subdivide into separate <br />lots for each building. The lot size meets the minimum lot size of 8,000 square feet for the <br />Central Business (C-1) zoning district. <br />C. Site Plan — Cattle House Restaurant <br />The site plan approval is for 2 acres on the north side of the property and includes the Cattle <br />House restaurant, outdoor gathering spaces/amenities along the lake, and a parking lot. The total <br />square footage for the restaurant is 5,700 square feet. The site plan shows an expansion for an <br />event center, but that is not being approved at this time. The applicant will need to apply for site <br />plan approval and other applicable approvals for the expansion. <br />7 <br />
