If the permit is to approve a wetlands replacement plan, the plan is in <br />conformance with the rules of the state board of soil and water resources for <br />such plans. Does not apply. <br />12. The applicant or operator shall obtain all necessary state and local permits for <br />the conditional use. The applicant is required to obtain all necessary state and <br />local permits as a condition of approval. <br />13. The proposed use is adequately buffered and screened from noncompatible <br />land uses and public rights-of-way. The application complies. The use is <br />appropriately sited and adequately buffered. <br /> <br />C. Conclusions <br /> <br />Staff has reviewed the site plan and conditional use permit for consistency with the <br />applicable City standards and finds that the proposed project generally conforms. <br />However, there are several outstanding issues that must be clarified, and conditions that <br />must be met by the applicant to ensure compliance with City standards. Staff believes <br />that these issues can be addressed through the conditions of approved as <br />recommended in the attached resolutions. <br /> <br />4. RECOMMENDATION: <br /> <br />Move to adopt the following resolution to approve “Apple Academy”, as recommended <br />by the Planning Commission: <br />a. Resolution Approving the Site Plan, Conditional Use Permit and Development <br />Contract <br /> <br />ATTACHMENTS: <br />a. Resolution Approving the Site Plan and Conditional Use Permit <br />b.
