<br /> <br /> <br />Apple Academy 8 <br />year after the date of approval unless the property owner or applicant has substantially started <br />the construction of any building, structure, addition or alteration, or use requested as part of the <br />approved plan. The lot combination must be recorded with the Washington County Recorder (and <br />the mylar "hardshells" must be fully executed) within sixty (60) days of the Council motion giving <br />final site plan approval or else said approval shall be null and void. All fees relating to this site plan <br />shall be paid by the Developer, including the cost of recording documents with Washington County. <br /> <br /> b) Recording. The developer shall record the DA with Washington <br />County simultaneous with the recording of the lot combination and shall forward confirmation of the <br />DA to the City prior to the issuance of building permits. Final site plan approval shall be contingent <br />upon compliance with the grading, storm water drainage and utility plan approved and upon <br />compliance with this Development Agreement. <br /> <br /> c) Sales Trailers. The developer may be entitled to a maximum of one <br />temporary sales office (sales trailer) for this and all subsequent phases of the development for a period <br />of time not to exceed nine (9) months. Upon receipt of an acceptable site plan, a sales trailer may be <br />approved by the Community Development Director prior to the first model home being available for <br />showing. The trailer is subject to the issuance of a building permit, shall meet all applicable building <br />codes, shall be fully skirted, shall be suitably landscaped, shall contain sufficient parking for the size <br />of the office, and shall have safe and suitable access to a paved, public roadway. The trailer shall be <br />removed, and the site shall be restored within seven (7) days following the date that a model home <br />passes final inspection. <br /> <br /> d) Deviations. No material deviations from the approved final site plan <br />shall be allowed unless approved in writing by the City. Approval herein is also given subject to full <br />compliance with the conditions of approval and findings adopted by the Planning Commission and <br />City Council in connection with the approval of the development. <br /> <br /> e) Certificates of Survey. A certificate of survey shall be provided to <br />the Building Inspector for each lot at the time a building permit is requested for the lot. Attached to <br />the certificate of survey shall be an erosion control plan for the lot showing location and type of all <br />erosion control measures to be used on the lot, and a grading plan, tree preservation and landscaping <br />plan shall be submitted for each home site. <br /> <br /> f) Outhouses. The Developer shall provide on-site a sufficient number <br />of portable outhouses to be available for the persons who will be working on-site until improvements <br />are accepted according to the plans in Exhibit A. <br /> <br /> g) The City may, free of claims of cost, loss or damage by Developer, <br />withhold any permits at any time because of sewer capacity limitations or other infrastructure <br />limitations.
