<br /> <br />Waters Edge 6th Addition 10 <br />available for showing. The trailer is subject to the issuance of a building permit, shall meet all <br />applicable building codes, shall be fully skirted, shall be suitably landscaped, shall contain <br />sufficient parking for the size of the office, and shall have safe and suitable access to a paved, <br />public roadway. The trailer shall be removed, and the site shall be restored within seven (7) days <br />following the date that a model home passes final inspection. <br /> <br /> e) Deviations. No material deviations from the approved Plat shall be <br />allowed unless approved in writing by the City. Approval herein is also given subject to full <br />compliance with the conditions of approval and findings adopted by the City Council in connection <br />with the approval of the development. <br /> <br /> f) Certificates of Survey. A certificate of survey shall be provided to <br />the City Building Inspector for each lot at the time a building permit is requested for the lot. <br />Attached to the certificate of survey shall be an erosion control plan for the lot showing location and <br />type of all erosion control measures to be used on the lot, and spot elevations, tree preservation plan <br />shall be submitted for each home site. <br /> <br /> g) Outhouses. The Developer shall provide on-site a sufficient number <br />of portable outhouses to be available for the persons who will be working on-site until <br />Improvements are accepted according to the plans in Exhibit A. <br /> <br /> h) Property Owners Association. When required as a condition of <br />approval outlined in Exhibit B, the Developer agrees to form a property owners association, <br />membership in which shall be mandatory for all of the lots within this development. The property <br />owners association shall be responsible for maintenance and repair of all common elements as <br />listed in the property owners association documents within this development and the same shall be <br />maintained in good condition in accordance with all City ordinances and reasonable directions of <br />the City. Developer agrees to provide a copy of the property owners association documents to the <br />City prior to the recording of the final plat. In the event of failure or refusal of any property owners <br />association to so maintain or repair the common elements then the City may, with seven days <br />written notice and without regard to the requirements or formalities of Minn. Stat. §429 perform the <br />work and assess each of the lots within the plat for the cost of the work. <br /> <br /> i) The City may, free of claims of cost, loss or damage by Developer, <br />withhold any permits at any time because of sewer capacity limitations or other infrastructure <br />limitations. <br /> <br /> j) The property owners association documents shall advise owners of <br />all lots of the requirements of this Agreement as follows: THE LAND WITHIN THIS PLAT, <br />INCLUDING THE LAND CONVEYED HEREIN, IS BOUND BY RESTRICTIONS IN A <br />DEVELOPMENT AGREEMENT. SAID DEVELOPMENT AGREEMENT IS ON FILE
