Variance <br />request from the rear yard setback requirement. <br /> <br />DATE: June 10, 2020 for the City Council Meeting on June 15, 2020. <br /> <br />ZONING: Large Lot Single Family Residential (R-1). <br /> <br />REVIEW DEADLINE: June 16, 2020. <br /> <br /> <br />1. BOARD OF ZONING UPDATE: <br /> <br />At its May 28, 2020 meeting, the Hugo Board of Zoning Adjustments considered the variance <br />request from the rear yard setback requirement for the proposed accessory building submitted by <br />Richard Degnan. The Board held a public hearing but no one spoke. Comments were provided to <br />Board members that requested that the applicant use similar materials to that of the home on the <br />property as well as maintain the vegetation along the rear property line. Staff provided <br />background and recommended approval of the request. The Board agreed that the request met <br />the criteria necessary to approve the application and recommended approval of the variance <br />request to the City Council. <br /> <br />2. BACKGROUND AND DESCRIPTION OF REQUEST: <br /> <br />The applicant is requesting a variance from the rear yard setback requirement for a proposed <br />accessory building. The request is to allow the accessory building to be built 10 feet from the <br />rear lot line where 30 feet is required by ordinance. The property is approximately one acre and <br />is located within the Large Lot Single Family Residential (R-1) zoning district. <br /> <br />3. LEVEL OF DISCRETION IN DECISION MAKING: <br /> <br />The City has discretion in approving or denying rezoning applications, based on whether or not <br />the proposal meets the standards outlined in the Comprehensive Plan and Zoning Ordinance <br />requirements. If the City finds that all the applicable standards are met, the rezoning application <br />must be approved. However, if the City finds that any of the applicable standards are not met, the <br />application may be denied.
