RESOLUTION 2020 - 33 <br />APPROVING PRELIMINARY PLAT FOR "HUGO GARDENS" (PID 20-031-21-23-0058) <br />WHEREAS, Hugo Gardens Apartments, LLC has requested approval of a preliminary plat to <br />create a single lot to allow construction of 84 apartment units: <br />Outlot B, LaValle Fields First Addition <br />WHEREAS, the Planning Commission has reviewed said preliminary plat at a duly called Public <br />Hearing on May 14, 2020 and recommends approval subject to the conditions listed; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve the request by Hugo Gardens <br />Apartments, LLC for the preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to create Lot 1, Block 1, Hugo Gardens lot, in accordance <br />with the application and plans received on February 21, 2020, except as amended by this <br />resolution. <br />2. The preliminary plat approval is contingent upon approval of the requested PUD <br />Amendment. <br />3. The developer must comply with Resolution 2020-_ for the PUD Amendment. <br />4. The developer is responsible for improvements to Finale Avenue North, as shown on the <br />plans and amended with the resolution, from 146th Street North to the north end of the <br />right-of-way dedicated for Finale Avenue on the plat. The entire length of the Finale <br />Avenue North realignment through the project shall be constructed with the first layer of <br />bituminous prior to the issuance of a Certificate of Occupancy for the 1 st building. <br />5. The developer shall evaluate the feasibility of a stormwater reuse project for the <br />development. If a stormwater reuse project is feasible, as evaluated by the City, it shall <br />be constructed. This may include the connection to another stormwater reuse system. <br />6. Park dedication shall be cash -in -lieu of land in the amount of $87,414.72 due at the time <br />of final plat. <br />7. The applicant must submit an application for Vacation of the existing easement in the west <br />portion of the site with the Final Plat application. <br />8. Prior to final plat approval, the developer must comply with the following conditions: <br />a. The developer must comply with all conditions outlined in the City Engineer's <br />memos dated May 7, 2020. <br />
