The property <br />is zoned Business Park (BP) and is guided as Business Park (BP) in 2040 Comprehensive Plan. <br /> <br />2. CONTEXT: <br /> <br />A. Surrounding Land Use and Zoning <br /> <br />The properties to the north are zoned Planned Unit Development (PUD) and are occupied by <br />townhome developments. The properties to the east are zoned General Industrial (I-3) and are <br />occupied by industrial businesses. The property to the south is zoned Business Park (BP) and is <br />occupied by the Xcel Energy Training Center. The property to the west is zoned Large Lot <br />Single Family Residential (R-1) and is occupied by the City owned Clearwater Creek Preserve <br />park. <br /> <br />B. Existing Site Characteristics <br /> <br />The property is generally flat and contains some wetlands on the property. There is shared <br />stormwater management for the entire site, included in the outlot that will be created. <br /> <br />3. BACKGROUND: <br /> <br />In 2018, the City Council approved a CUP for a campus development that approved the location <br />and use of four proposed buildings on the site. The general location of the buildings remain the <br />same with this request. <br /> <br />4. ANALYSIS: <br /> <br />A. Level of City Discretion in Decision-Making <br /> <br />The City’s discretion in approving or denying a preliminary plat is limited to whether or not the <br />proposed plat meets the standards outlined in the subdivision regulations in the City Code. If it <br />meets these standards, the City must approve the preliminary plat. <br /> <br />The City’s discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br /> <br />The City’s discretion in approving or denying a conditional use permit amendment is limited to <br />whether or not the proposed application meets the standards outlined in the City’s <br />Comprehensive Land Use Regulations. If it meets these standards, the City must then approve <br />the conditional use permit. <br /> <br />B. Preliminary Plat and Final Plat <br /> <br />The preliminary plat and final plat will include 2 lots and 1 outlot. The preliminary plat and final <br />plat complies with ordinance requirements.
