Agenda Number: G.22

CITY OF HUGO

PLANNING AND ZONING
APPLICATION STAFF REPORT

TO: Bryan Bear, City Administrator

FROM: Rachel Juba, Community Development Director

SUBJECT: Paul and Linda Holman and Xcel Energy - Property Line Adjustment
– 15121 Everton Avenue North

DATE: December 30, 2020 for the City Council Meeting of January 4, 2020

1. PROPOSED MOTION:

Move approval of a resolution approving a property line adjustment for Paul and Linda Holman
and Xcel Energy.

2. DESCRIPTION OF REQUEST:

The applicants are requesting approval of a property line adjustment for properties located at
15121 Everton Avenue North. There is long line of property that Xcel Energy owns across the
northwest quadrant of the City for their power lines. Over the years, Xcel has been working with
property owners to deed the property to the adjacent property owners and acquiring an easement
in return. Some of these interactions require a property line adjustment or subdivision of
property. The applicants are proposing to have the Xcel Energy property that dissects the
property be adjusted to the north. Mr. Holman will dedicate an easement to Xcel Energy in the
same location. The applicants have agreed on the easement location.

3. ANALYSIS:

Section 90-339, (2), of the City’s Comprehensive Land Use Regulations state that, “Where the
adjustment of the property line between two properties retains or causes both properties to be in
conformance with this chapter, the zoning administrator shall provide the application to the city
council for administrative review and consideration”.

Findings

Staff finds that the property line adjustment reduces the extent of any nonconformities.
