Victor Land Holdings, LLC, Pre Plat, Final Plat, Site Plan, CUP, Variance, and Easement Vacation <br />Page 10 <br />(12) The applicant or operator shall obtain all necessary state and local permits for the <br />conditional use. <br />The applicant shall be responsible for all necessary state and local permits. <br />(13) The proposed use is adequately buffered and screened from noncompatible land uses and <br />public rights-of-way. <br />Office/warehouse buildings are allowed in the General Industrial (I-3) zoning district. There is <br />no need to screen the buildings. They are not proposing exterior storage with the project. <br />D.Easement Vacation <br />The applicant will need to vacate existing drainage and utility easements with this project. New <br />drainage and utility easements will be placed on the property with this project. <br />5.CONCLUSION: <br />Staff finds that the proposal meets all the requirements necessary for the City to approve the <br />preliminary plat, site plan, conditional use permit, variance, and easement vacation as outlined in <br />the City Code and zoning regulations, if the appropriate conditions are met in the attached <br />resolutions and conditional use permit. <br />6.STAFF RECOMMENDATION: <br />Staff recommends approval of the preliminary plat, site plan, conditional use permit, variance, <br />and easement vacation applications for Victor Land Holdings, LLC, for the property located at <br />the northeast corner of 130th Street North and Fenway Boulevard North, subject to the conditions <br />listed in the resolutions. At the time of the Planning Commission meeting, the site plan <br />resolution included the condition that the applicant add brick, stone, or block (or like material) 3 <br />feet in height around the buildings. <br />7.PLANNING COMMISSION RECOMMENDATION: <br />The Planning Commissioners generally agreed that they liked the plans and the overall design of <br />the building, including the architectural metal panel building material. They felt the materials <br />were high quality and met the intent of the design guidelines. They found the applications met all <br />the requirements necessary to approve the applications. The Planning Commission unanimously <br />approved the applications, subject to the conditions in the resolutions, with the revision to the <br />site plan resolution to remove the requirement to add brick, stone, or block (or like material) 3 <br />feet in height around the buildings. The resolutions in the City Council packet reflects the <br />Planning Commission recommendation.
