The developer shall be required to extend Farnham Avenue North through <br />City -owned property at their expense. <br />i. The developer shall provide a legal description and right of way <br />document for the public road constructed on the City -owned <br />property. <br />b. The developer is required to provide a curb cut to allow access to the City <br />water tower, as indicated on the approved plan set. <br />Covenants <br />a. The developer shall establish covenants to implement architectural design <br />guidelines for all residential buildings. The covenants shall be reviewed <br />approved by City staff. <br />Wetlands <br />a. The wetland mitigation plan shall be reviewed and approved by the <br />Technical Evaluation Panel. <br />Utilities <br />a. The developer shall obtain approval of a permit from the Rice Creek <br />Watershed District to allow a ditch crossing for the utility connection to the <br />east. <br />Miscellaneous <br />a. The developer must obtain all necessary stormwater management and WCA <br />permits from the City. <br />b. The developer shall obtain all necessary local, state, and federal permits. <br />11. Prior to the release of a final plat for recording, the developer must comply with the <br />following conditions: <br />a. The City's development fees will apply to this project. The fee amounts will <br />be calculated and included as part of the Development Agreement. A <br />development agreement shall be executed and all fees shall be paid. <br />
