RESOLUTION 2021-50 <br />APPROVING A FINAL PLAT AND DEVLEOPMENT AGREEMENT FOR DRENGSON <br />MAY ENTERPRISES, LLC FOR ACRES OF BALD EAGLE <br />WHEREAS, Drengson May Enterprises, LLC, has requested approval of a final plat to develop 9 <br />lots to be known as "Acres of Bald Eagle" located north of 121 st Street North and west of Falcon <br />Avenue North and is legally described as follows: <br />(see attached) <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called public <br />hearing and recommended approval of the preliminary plat; and <br />WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on July 19, <br />2021; and <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by Drengson May <br />Enterprises, LLC, for a final plat, subject to the following conditions: <br />1. The final plat is approved to allow the creation of 9 single family lots 9, in accordance <br />with the plans and application received by the City on April 23, 2021, except as amended <br />by this resolution. <br />2. The development shall substantially comply with all plans and conditions of the <br />preliminary plat approval granted by the City on July 19, 2021. <br />3. The developer shall comply with all conditions outlined in the City Engineer's memo <br />dated July 15, 2021, and revisions required in "redlined" comments from the City <br />Engineer. <br />4. The preliminary plat is contingent on the variance application being approved for lot <br />width for lots 8 and 9. <br />5. Development is subject to the R-1 zoning district regulations. Lots 8 and 9 shall meet the <br />Shoreland Overlay Zoning District Regulations. <br />6. The preliminary plat shall be revised to include the correct density calculations. <br />7. The grading plan shall be revised to move the grading away from adjacent properties. <br />The applicant shall continue to work with the City on the dimension. <br />8. The applicant shall construct 121St Street to a paved rural section roadway standard. The <br />developer shall be responsible for the improvement cost, including utilities, for the <br />development and it shall be paid for by the applicant. <br />
