RESOLUTION NO.2021-51 A RESOLUTION ORDERING THE PROJECT, APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS FOR THE 121ST STREET AND ACRES OF BALD EAGLE UTILITY AND STREET IMPROVEMENTS WHEREAS, pursuant to resolution of the Council adopted June 7, 2021, a feasibility report was prepared by WSB, with reference to the improvement of 121" Street from Everton Avenue to Falcon Avenue and The Acres Of Bald Eagle; and WHEREAS, it is proposed to construct new sanitary sewer, watermain, street, and to reconstruct the existing aggregate surfaced roadway with bituminous pavement; and WHEREAS, the City intends to assess benefited properties for all or a portion of the improvements as recommended in the feasibility report, pursuant to Minnesota Statutes, Chapter 429, and WHEREAS, the City Council has received and accepted the feasibility report prepared by the City Engineer on June 21, 2021, for the 121 st Street and Acres Of Bald Eagle Improvements; and WHEREAS, a resolution of the City Council adopted on June 21, 2021, fixed a date for the Council public hearing on the proposed improvements; and WHEREAS, ten days' mailed notice and two weeks' published notice in advance of said public hearing was given and the hearing was held thereon July 19, 2021, at which time all persons desiring to be heard were given an opportunity to be heard thereon. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUGO: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report for the 121St Street and Acres Of Bald Eagle Utility and Street Improvements. 2. Such improvement is hereby ordered as proposed in this Council resolution adopted July 19, 2021. 3. The improvements described in the notice of public hearing and the feasibility report are hereby designated and shall be known as the 121' Street and Acres Of Bald Eagle Utility and Street Improvements. 4. Plans and specifications prepared by the engineer for such improvement pursuant to council resolution, a copy of which are on file at City Hall, are hereby approved. 5. The City Clerk shall prepare and cause to be inserted in the official City newspaper and the Finance and Commerce an advertisement for bids upon the making of such improvement under such approved plans and specifications. 6. The City Council shall let the contract for all or part of the work for said improvements or order all or part of the work done by day labor or otherwise as authorized by Minnesota Statutes, Section 429.041, Subdivision 2 within one year of the date of this Resolution ordering said improvements.
