I.1 <br /> <br />Short-Term Rental means any temporary occupancy of a dwelling unit, a portion of a dwelling unit, or any <br />other portion of a property or structure, which is offered for rent to a transient as a dwelling for fewer than <br />30 consecutive calendar days. This term does not mean Bed and Breakfast as otherwise defined in this <br />section. <br /> <br />Transient means any person who, at their own expense or at the expense of another, exercises occupancy or <br />possession, or is entitled to occupancy or possession, by reason of any rental agreement, whether in writing <br />or otherwise, concession, permit, right-of-access, option to purchase, license, time-sharing arrangement, or <br />any other type of agreement. <br /> <br />Chapter 90 – Zoning and Land Use <br />Article VI – Requirements for Specific Uses and Performance Standards <br />Sec. 90-264. Short-Term Rentals - Prohibited. <br />(a) Prohibition. It shall be unlawful for any person or entity to offer for rent, or enter into a rental <br />agreement, a dwelling unit, or any other portion of their property, as a Short-Term Rental in any <br />zoning district within the City. State-licensed hotels, motels, and lodging establishments located in <br />areas where expressly permitted by the City’s land use regulations are allowed, subject to all <br />applicable law and rules. <br />
