RESOLUTION 2021 - XX <br /> <br />APPROVING A VARIANCE REQUEST FROM LUKE HANSCOM TO ALLOW <br />A FRONT YARD BUILDING SETBACK OF 25 FEET, WHERE 30 FEET IS <br />REQUIRED BY ORDINANCE, AT PROPERTY LOCATED AT 12096 EVERTON <br />AVENUE NORTH <br /> <br />WHEREAS, Luke Hanscom has requested approval of a variance to allow front yard <br />building setback of 25 feet, where 30 feet is required by ordinance, at property legally <br />described as: <br /> <br />Lots 1 and 2, except the South 40 feet thereof, and Lots 3 and 4, Block 10, SHADYSIDE <br />No. 4 and the south 26 feet of Euclid Avenue nka 121st Street North that lies West of the <br />East line of Block 10 extended North, according to the recorded plat thereof, and situate <br />in Washington County, Minnesota. <br /> <br />WHEREAS, the Board of Appeals and Adjustments has reviewed said variance at a duly <br />called public hearing on August 26, 2021, and recommends approval with the following <br />findings and conditions: <br /> <br />1. The proposed garage addition shall be in adherence to the Certificate of Survey <br />dated August 5, 2021. <br /> <br />2. The proposed variance is permissible by law. <br /> <br />3. There are practical difficulties in meeting the ordinance standards. <br /> <br />a. Reasonable Use – The applicant’s request to add on to an existing garage <br />is reasonable. <br /> <br />b. Unique Circumstances – The property is under unique circumstances as <br />the existing house and garage do not meet the front yard building setback <br />requirements. <br /> <br />c. Character of the Neighborhood – There are several properties in the area <br />that have similar front yard building setbacks and the variance will not <br />alter the essential character of the neighborhood. <br /> <br />4. The variance meets the spirit and intent of the ordinance. <br /> <br />5. The variance does not affect the surrounding properties. <br /> <br />6. The property is not located within a floodplain area. <br /> <br />7. The property is served by City sewer and water. <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request for Luke Hanscom to allow a front yard building setback of 25 feet, <br />where 30 feet is required by ordinance, at property located at 12096 Everton Avenue <br />North. <br />
